CNMC launches consultation over Telefónica's wholesale fibre charges

The Comision Nacional de los Mercados y la Competencia (CNMC) has launched a consultation to determine how the tariffs alternative operators pay to access Telefónica's wholesale fibre network is calculated.




The Spanish regulator hopes the consultation will allow rivals to easily replicate the main fibre rates offered by Telefonica, promoting competition in the market. 

CNMC is looking to enforce new wholesale tariffs in Spain from January 2018, alongside new wholesale service NEBA, which was approved in January 2017. NEBA will see Telefónica offer virtual access to its fibre network across all of Spain, barring 66 pre-determined cities which the regulator declared as already competitive.

According to the proposed criteria, the rules will cover a set of 12 flagship products which group more than 80% of Telefónica's fibre customers.

It will also determine what CNMC is calling the “replicability test”, which includes particular emphasis on converged packages including other products like mobile or content. 

Packages that do not allow alternative operators to replicate the set of flagship products will automatically see an adjustment in prices of wholesale NEBA offers, according to the proposals.

These rules will be updated every six months, CNMC said, to evaluate the replicability test according to any adjusted parameters. These could lead to further adjustments to wholesale price.

The CNMC has given stakeholders month to submit their answers or views on the consultation via their website.
